1. Agreement overview
By accessing our services, requesting or reserving donor material, or completing registration with BirthAsia, you agree to be bound by these Terms and Conditions. Carefully review this agreement before proceeding. If you do not agree, do not use our services.
2. Patient registration & identity verification
2.1 Required information
All patients must provide complete and accurate information if requested, including:
- Full legal name (matching government-issued identification)
- Date of birth or age
- Current residential shipping address
- Valid contact information
- Proof of identity
2.2 Identity confirmation requirements
- Only the registered female recipient may receive and utilize provided gametes.
- We reserve the right to verify identity at any time during treatment.
2.3 Accuracy warranty
You warrant that all information provided is truthful, current, and complete. Misrepresentation of age, health status, identity, or other material facts constitutes grounds for immediate termination of services and potential legal action.
2.4 Refusal of service
We reserve the right to refuse service to potential recipients, within our own discretion.
3. Use of provided gametes
3.1 Authorized use only
The provided sperm is licensed for personal use solely in creating a pregnancy for the registered patient. This includes:
- At-home insemination procedures
- Fertility treatments using approved protocols
3.2 Strictly prohibited activities
Without limitation, you expressly agree not to:
- Resell, redistribute, or commercially exploit donated gametes.
- Transfer, give away, or share samples with third parties.
- Attempt to extract, analyze, sequence, or reverse-engineer the sperm or genetic material from received samples.
- Use samples for research purposes without explicit written consent and separate agreements.
- Import or export samples across borders without regulatory clearance.
3.3 Genetic material protection
You acknowledge that donor genetic material constitutes proprietary biological property. No right, title, or ownership interest is transferred to you beyond limited usage rights described herein. Attempting to isolate, decode, replicate, or derive additional information from the samples violates these terms.
4. Donor privacy & consent
4.1 Donor anonymity
We comply with applicable anonymity laws. Where donors have chosen anonymous donation, recipients understand they will not receive identifying information except where required by law or upon donor consent. Upon reaching the age of adulthood, a child born of sperm donation may contact us to request information on the biological father, and we will forward the request to the donor.
4.2 Recipient privacy
You agree to maintain confidentiality regarding respecting donor anonymity when donors have chose anonymous donation. You also agree not to uncover or reveal the identities of our other recipients of sperm donation.
4.3 Future contact protocols
If local laws permit donor-child contact upon reaching adulthood, such communications follow established registry procedures administered by our firm or relevant authority.
5. Medical disclaimer & limitations
5.1 No pregnancy guarantee
Receipt of gamete samples carries inherent risks and uncertainties. Success rates vary based on numerous factors including age, fertility status, underlying conditions, and individual response to treatment. We cannot guarantee pregnancy or live birth outcomes.
5.2 Health screening limitations
While we screen donors according to industry standards, screening cannot identify every possible genetic condition, carrier status, or future health risk.
5.3 Patient liability waiver
To the extent permitted by law, you waive claims against our company, donors, staff, and affiliated medical professionals arising from:
- Treatment outcomes or failures
- Undisclosed donor health issues not detectable through standard screening
- Genetic conditions present in offspring
6. Payments
6.1 Altruistic donation
All sperm is provided for free at no cost, and you agree that our delivery of sperm to you does not constitute a sale or purchase in any form.
7. Storage & shipping
7.1 Storage
Samples are stored according to contractual period and local regulations.
7.2 Transportation compliance
Shipping follows all biological material transport regulations. Delays due to temperature excursions or logistical issues may occur; we accept no liability for resulting damage unless proven negligent.
8. Termination
We may immediately terminate access and services if you:
- Breach any term of this agreement
- Provide false or misleading information
- Engage in prohibited activities listed in these terms
- Or upon our own discretion
9. Intellectual property & confidentiality
Our protocols, databases, donor matching systems, and proprietary methods constitute trade secrets protected by intellectual property law. Reverse engineering, de-compilation, or unauthorized extraction of data from any materials supplied is strictly prohibited.
10. Legal dispute resolution
10.1 Governing law
These terms shall be interpreted under the laws of the jurisdiction of the customer shipping address, without regard to conflict-of-law principles.
10.2 Arbitration or mediation requirement
Disputes shall be resolved through mediation or binding arbitration. Both parties waive right to jury trial or class actions.
10.3 Injunctive relief
We retain the right to seek injunctive remedies preventing irreparable harm, including disclosure breaches, sample misuse, or ongoing violations.
11. Amendments to Terms
We may update these terms periodically. Continued use after changes constitutes acceptance.
12. Acknowledgement
By purchasing, requesting or reserving our services, you certify that:
- You have read, understood, and voluntarily accepted all terms.
- You are of legal age in your jurisdiction to enter binding contracts.
- You will be the sole recipient and user of provided materials.
- You understand sample misuse may result in civil/criminal penalties.
- You have had opportunity to consult independent legal counsel.
